§ 1 GENERAL PROVISIONS

  1. The online store https://clever-teacher.com/ is run by: Mcreative Mateusz Peszko with its registered office at: Szkolna 12 Street, 05-306 Mistów, Poland, TAX ID: 1132919143, REGON number: 367206042. E-mail adress: contact@clever-teacher.com.
  2. The store sells educational aids, worksheets, school newspapers, etc., in electronic and digital form.
  3. The Store operates under the principles set out in these Regulations.
  4. The Customer is required to read the following Terms and Conditions before using the Store. By using the Store, the Customer accepts these Terms and Conditions.

§ 2 DEFINITIONS

  1. CUSTOMER – a person who intends to conclude or has concluded a Sales Agreement with the Seller.
  2. CONSUMER – a natural person who concludes a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
  3. ENTREPRENEUR – a natural person, a legal person and an organizational unit that is not a legal person, to which the law grants legal capacity, conducting business, unregistered or professional activity on its own behalf.
  4. PRODUCT – an item available in the Store in digital file format that is the subject of the Sales Agreement between the Customer and the Seller.
  5. REGULATIONS – these regulations of the Store.
  6. SHOP – The Service Provider’s online store operating at https://clever-teacher.com/
  7. SALES AGREEMENT – Product Sales Agreement concluded between the Customer and the Seller via the Store.
  8. ORDER – a declaration of will of the Customer constituting an offer to conclude a Product Sales Agreement with the Seller.

§ 3 TECHNICAL REQUIREMENTS

  1. To use the Store, you must be connected to the Internet via a web browser installed on your device.
  2. To process the order, an active email address is required for the Customer to receive notifications about the order status.
  3. In order to place an order in the Store, the Customer must have an active user account, which he or she can create in the Store.

§ 4 PRE-PURCHASE INFORMATION (PRODUCTS AND ORDER)

  1. The products offered in the Store are subject to copyright and may not be made available on the Internet or resold.
  2. Products are offered in digital form (downloads).
  3. To use the products, the Customer needs an office suite installed on the computer, e.g. Microsoft Office, OpenOffice, LibreOffice or another browser that opens a file with a given extension (e.g. Adobe Reader for .pdf files).
  4. The Product price displayed on the Store’s website is given in Euros (€) and US Dollars ($) and includes all components.
  5. The condition for placing an Order in the Store by the Customer is to read the Regulations and accept their provisions at the time of placing the Order.
  6. The Customer places a purchase on the “ORDERS” page by clicking the “BUY AND PAY” button and paying for the order online.
  7. The conditions for withdrawing from the contract are described in § 10 of the Terms and Conditions.

§ 5 CONCLUSION OF THE SALES AGREEMENT

  1. To conclude a Sales Agreement, the Customer must first set up an account in the Store.
  2. After placing the Order, the Seller immediately confirms its receipt by e-mail.
  3. Upon receipt by the Customer of the e-mail referred to in point 2 of this paragraph, a Sales Agreement is concluded between the Customer and the Seller.

§ 6 PAYMENT METHODS

  1. The seller provides the following payment methods: Stripe payment gateway (fast online payment, payment by transfer, card) and PayPal.
  2. In the case of payment via an electronic payment system, the Customer makes the payment during the execution of the Order.
  3. Products are made available in the Customer’s account automatically after the order is paid (the payment gateway system may take a few minutes to process the payment status).


§ 7 DELIVERY

  1. Products sold in the Store are available only in digital format. Customers receive access to them after purchasing and paying for the order in their account under the “Downloads” tab.

§ 8 INVOICES

  1. After purchase, the customer receives an invoice via email and can download it in the account panel.
  2. The Seller only sells to private individuals.


§ 9 COMPLAINTS

  1. The sales contract covers new, proprietary products made available to the Customer in digital form.
  2. If the Customer discovers a defect in the purchased product, he or she has the right to file a complaint, which should be reported to the seller at the following e-mail address: contact@clever-teacher.com, including: the order number; information about the products the complaint concerns; and a description of the complaint.
  3. The Seller will respond to the submitted complaint within no more than 14 days and, if it considers it justified, will propose a way to resolve it, e.g. a refund to the account.

§ 10 RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. A customer who has concluded a distance contract may withdraw from it without giving any reason by submitting an appropriate declaration within 14 days of purchase.
  2. Digital products can only be returned if the file has not been downloaded from the Customer’s account. Otherwise, the right to withdraw from the contract is considered individually after the Customer submits a statement to the following email address: contact@clever-teacher.com
  3. In the event of withdrawal from the Agreement, the Seller shall refund the Consumer the amount due for the product/products within a period not longer than 14 days from the date of receipt of information from the Consumer about withdrawal from the agreement.
  4. The refund of the amount due will be made directly to the Customer’s bank account.

§ 11 FINAL PROVISIONS

  1. Contracts concluded through the Store are concluded in accordance with Polish law.
  2. In the event of any non-compliance of any part of the Regulations with applicable law, the relevant provisions of Polish law shall apply instead of the disputed point of the Regulations.
  3. Any disputes arising from Sales Agreements between the Store and Consumers will be resolved primarily through negotiation, with the intention of resolving the dispute amicably, taking into account the Act on Out-of-Court Resolution of Consumer Disputes. However, if this is not possible or is unsatisfactory for either party, disputes will be resolved by a competent common court, in accordance with point 4 of this section.
  4. Any disputes arising between the Service Provider and the Service Recipient (Customer) who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure of 17 November 1964 of Polish law.

  6. The Regulations are subject to change. Contracts concluded before the amendment to the Regulations will be governed by the version of the Regulations in effect on the date the Customer places their order.
  7. The Regulations come into effect upon publication on the Store’s website.
